About JMK

Client Testimonial

Our client sustained personal injuries whilst on holiday in the Caribbean. On the second last day of his holiday when in his hotel room he slipped and fell on some water on the floor caused by a leaking pipe in the ceiling. He completed the Accident Report Book and attended with the on-site nurse where first aid was administered and he was found to have sustained an injury to his leg.

As the client’s holiday fell within the definition of a Package Holiday under Regulation 2 of the Package Travel Package Holidays and Package Tours Regulations 1992, we advised our client that his losses could be recovered against the UK Tour Operator. We obtained medical evidence in relation to his injuries and he was found to have sustained a soft tissue injury to his leg which impacted on his hobby of attending the gym. After receiving no response to our letter of claim we issued proceedings against the Tour Operator and took the matter to hearing.

After not engaging with us during the course of the case on the morning of trial the Tour Operator eventually admitted liability for our client’s injuries and his case settled in the sum of £6250 plus costs.

Call JMK Solicitors now on 028 9032 0222 for a FREE initial consultation.

JMK is the only solicitors in Northern Ireland who, as far as we are aware, can offer you a complimentary full peace of mind legal expenses insurance policy.

This policy gives protection against the financial risks of bringing a claim for compensation for personal injury and other losses.

Even more impressive, this policy covers not just your opponent’s costs, but also your own costs if they cannot be recovered from another party.

This means that, unlike with other firms, when JMK provide this insurance to you, you will never be asked to pay for it from any compensation awarded.

Had an accident abroad? What you need to know

While holidays are a time to relax and rejuvenate, it’s important to know your rights, and what to do, if you are unfortunate to be involved in an accident that is not your fault while away.

If you have booked a package holiday (your hotel and flights together) and have been injured because of a mistake by your hotel, for instance, if you have slipped, or contracted food poisoning, you may have a right to claim at home, where your contract was formed between you and your tour operator. Claims such as these apply worldwide.

Top tips:

  1. Take photographs at the scene of the accident if it’s safe to do so.
  2. If a road traffic accident: note the registration number of both the vehicle you were travelling in, and any other vehicles involved. Obtain the details of the drivers involved including insurance details, and any witness details too. If the other vehicle is a lorry with a trailer, make sure you take photographs of both as the insurers may be different.
  3. You may be asked to complete a European Accident Statement, (EAS), at the scene. Ensure all details completed are accurate and correct and obtain a copy or take a photograph of this too.
  4. If emergency services are called to the scene, take a note of which station/ hospital etc they are attached to.
  5. If you are buying travel insurance, which is always recommended, before you go to cover instances such as accidents and notify your insurance company as soon as you are involved in one. It is also important to travel with an EHIC (European Health Insurance Card) when in Europe.
  6. Ensure you are adequately insured when taking your own car abroad. Report all accidents as soon as possible to your insurance company, or to your hire car provider if applicable. We would also recommend you read carefully the terms of your hire car agreement. For example you may be subject to damage costs if not adequately protected against these costs.
  7. Keep a note of any medications you have been prescribed while away including the name and address of the medical provider you attended.

How long will it take to get compensation?

This is dependent on the circumstances of your case and we cannot give you a clear estimate until you tell us the facts.

We would aim to have all travel claims concluded as quickly as possible, but the time taken to reach settlement will be dependent on the nature of the claim and if there are any ongoing injury symptoms, and how quickly the responsible party can be identified and responds.
